1. Introduction

Welcome to TruDeals Realty Corp ("TruDeals Realty," "we," "our," or "us"). We are a licensed real estate brokerage in the State of Florida, dedicated to providing professional real estate listing and marketing services, including optional MLS (Multiple Listing Service) exposure.

These Terms & Conditions ("Terms") govern your use of our website, services, and any related tools, applications, or communications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Company Structure and Affiliates

TruDeals Realty Corp is a licensed Florida real estate brokerage providing brokerage and MLS listing services.

All For Sale By Owner (FSBO) advertising services and related marketing functions are offered exclusively through our affiliate, TruDeals Technology Corp (DBA TruDeals.com), a full-service advertising and marketing company.

TruDeals Realty Corp is not responsible for the management, performance, or refunds of FSBO advertising packages, which are governed under the separate Terms of Service of TruDeals Technology Corp.

3. Scope of Services

TruDeals Realty Corp provides the following real estate services to consumers:

• MLS listing and brokerage representation services under Florida real estate law.
• Transaction coordination and compliance assistance for listed properties.
• Buyer and seller consultation, offer preparation, and negotiation services.
• Optional professional photography, staging, and listing preparation services.

TruDeals Realty does not offer FSBO ad listings directly. All non-brokered marketing and advertising products are provided by TruDeals Technology Corp.

4. Fees and Payment Terms

All service fees, including MLS listing fees and transaction coordination fees, are disclosed prior to engagement and must be paid in accordance with the executed listing agreement.

The $995 flat-fee FSBO advertising package is processed by TruDeals Technology Corp and is non-refundable once the advertisement is published.

However, if the property sells through the MLS under TruDeals Realty Corp's brokerage, the $995 fee will be rebated in full at closing as a courtesy to the seller.

5. No Guarantee of Sale

While TruDeals Realty Corp employs professional marketing and listing strategies, we do not guarantee the sale or purchase of any property, nor specific marketing outcomes, lead volumes, or buyer interest.

Real estate results depend on various factors outside of our control, including market conditions, pricing, presentation, and buyer demand.

6. User Responsibilities

By using our Services, you agree that:

• You are at least 18 years old and legally capable of entering into binding agreements.
• You will provide accurate, current, and complete information in all interactions.
• You will comply with all applicable Florida real estate laws, including full disclosure of property details.
• You will not use our Services for any unlawful, fraudulent, or misleading purpose.

7. Brokerage Relationship Disclosure

Pursuant to Florida Statute 475.278, TruDeals Realty Corp may operate as a Transaction Broker unless otherwise disclosed in writing. This means we provide limited representation to both buyer and seller in a manner that does not compromise either party's interests.

Any change in brokerage relationship will be provided in writing in accordance with Florida law.

8. Limitation of Liability

To the fullest extent permitted by law, TruDeals Realty Corp, its officers, agents, affiliates, and employees shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of our Services, including but not limited to lost profits, data loss, or reputational harm.

Our total liability for any claim shall not exceed the amount paid by you for the specific service that gave rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless TruDeals Realty Corp, its affiliates, and representatives from any claims, damages, or expenses (including attorney fees) resulting from your misuse of the Services, breach of these Terms, or violation of any applicable law.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes arising from or relating to these Terms or the Services shall be resolved exclusively through binding arbitration in Collier County, Florida, administered in accordance with the rules of the American Arbitration Association.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

11. Intellectual Property

All content, branding, logos, and materials on the TruDeals Realty website are the exclusive property of TruDeals Realty Corp or its affiliates. Users are prohibited from copying, redistributing, or using such materials for commercial purposes without express written consent.

12. Third-Party Links

Our website may contain links to external websites or partners. TruDeals Realty Corp is not responsible for the content, policies, or reliability of these third-party sites. Access to such sites is at your own risk.

13. Termination of Access

We reserve the right to suspend or terminate access to our website or services at any time, for any reason, without prior notice, including but not limited to misuse, fraud, or violation of these Terms.

14. Updates and Modifications

We may update these Terms from time to time. Any changes will be effective immediately upon posting on our website with an updated "Last Updated" date. Continued use of our Services after updates constitutes acceptance of the revised Terms.
